Montblanc - MySignature for Good Sweepstake Rules

By completing this form with my personal details, I hereby expressly accept the following terms and conditions, which I have read and understood:

1. Prizes: One Grand Prize: A trip for two to Hamburg, Germany. Grand Prize includes 3 days/2 nights of double-occupancy accommodations; transportation between Hamburg airport and accommodation; and a personal factory tour provided by Montblanc. Prize includes coach-class airfare from major worldwide gateway cities. Winner and his or her travel companion are responsible for getting to one of these departure cities. Travel package is subject to availability at the time of reservation; allow at least three weeks for processing. Travel must be completed within one year from the ending date of sweepstake. Some restrictions on travel times and/or dates may apply.
Additionally, 2. - 10. prize: 9 (nine) high quality copies of the "Montblanc MySignature for Good-Artwork": one (1) prize per entrant. Prize is non-transferable and no substitution will be made except as provided herein at Montblanc's sole discretion. Winner of the original printout of the "Montblanc MySignature for Good-Artwork"is responsible for all taxes and fees associated with prize receipt and/or use. Odds of winning a Prize depend on the number of eligible entries received during the Registration Period (see below).

2. Eligibility: The Montblanc - MySignature for Good Sweepstake (the "Sweepstake") is open to any individual who is at least eighteen (18) years old at the time of entry, to the exclusion of employees of Montblanc and/or its related companies as well as their immediate family (spouse, parents, siblings and children) and household members of each such employee. Winning one of the one (1) original printout of the "Montblanc MySignature for Good-Artwork", the nine (9) high quality reproductions of the "Montblanc MySignature for Good-Artwork" and is contingent upon fulfilling all requirements set forth herein.

3. Sponsor: the Sweepstake is organised by Montblanc International GmbH, Hellgrundweg 100, 22525 Hamburg, Germany ("Montblanc"). Montblanc reserves the right to limit or discontinue this Sweepstake at any time and without notification at its discretion.

4. Timing & Registration:Registration for the Sweepstake begins on May 11, 2009 at 08:00 a.m. Central European Time (CET) and ends on September 8, 2009 at 12:00 p.m. CET (the "Registration Period"). Montblanc's computer clock is the official time keeping device for the Sweepstake. During the Registration Period, visithttp://www.mysignatureforgood.com/engagementand follow instructions to complete the registration. Complete and submit the registration. Multiple registrations by the same entrant will not be accepted and will lead to disqualification of the entrant. In order to sign up for the Sweepstake, a valid e-mail address will be required. Information collected from entrants is subject to Montblanc's Privacy Policy.

In order to validly register for the Sweepstake, "double opt-in" process applies. Any participant will need to confirm its Sweepstake registration by clicking on a link contained in an e-mail, which will be sent to every entrant. Such confirmation must be carried out as soon as the e-mail is received, otherwise the registration and e-mail address will be deleted from our database. You can unsubscribe from the Sweepstake registration at any time. To do so, just send an e-mail to info@mysignatureforgood.com.

5. Drawing: Montblanc's decisions as to the administration and operation of the Sweepstake and the selection of the winners are final and binding. Montblanc will randomly select the 10 (ten) Sweepstake winners from all eligible entries received during the Registration Period, on or around September 8, 2009. The winners will be notified by email within 10 (ten) days after the completion of the drawing. Each winner will be required to sign and return to Montblanc, within ten (10) days of the date notice or attempted notice is sent, a statement confirming acceptance of the prize. If a winner cannot be contacted, fails to comply with these terms and conditions within the required time period, such winner forfeits the prize. A winner must comply with all these terms and conditions, and winning is contingent upon fulfilling all requirements set forth herein. In the event that a winner is disqualified for any reason, Montblanc will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Only 5 (five) alternate drawings will be held after which the prize will remain unawarded.

6. Release: By receipt of any prize, winner agrees to release and hold harmless Montblanc and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstake.

7. Publicity: Except where prohibited, participation in the Sweepstake constitutes winner's consent to Montblanc's and its agents' use of winner's name, likeness, photograph, voice, opinions for promotional purposes in any media, worldwide, without further payment or consideration.

8. General Conditions: Montblanc reserves the right to cancel, suspend and/or modify the Sweepstake, or any part of it, if any fraud, technical failures or any other factor beyond Montblanc's reasonable control impairs the integrity or proper functioning of the Sweepstake, as determined by Montblanc in its sole discretion. Montblanc reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstake or to be acting in violation of these terms and conditions or in an unsportsmanlike or disruptive manner.

9. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstake; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstake; (4) technical or human error which may occur in the administration of the Sweepstake or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstake or receipt or use or misuse of any prize. No more than the stated number of prizes will be awarded.

10. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstake or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the competent Courts in Hamburg, Germany; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this sweepstake, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these terms and conditions, or the rights and obligations of the entrant and Montblanc in connection with the Sweepstake, shall be governed by, and construed in accordance with, the laws of Germany without giving effect to any choice of law or conflict of law rules.
